1. Introduction

These Terms and Conditions govern the provision of painting, waterproofing, and related services by Takesure Painters to clients across Pretoria East and the greater Tshwane metropolitan area. By accepting a quotation or engaging Takesure Painters to perform work at your property, you agree to be bound by these Terms and Conditions.

These terms comply with the Consumer Protection Act 68 of 2008 (CPA), the Protection of Personal Information Act 4 of 2013 (POPIA), and other applicable South African legislation. Where any provision of these terms conflicts with mandatory consumer rights under the CPA, the CPA prevails.

2. Definitions

“Takesure Painters” / “we” / “us”
Refers to Takesure Painters, a painting and waterproofing service provider operating in Pretoria East, Gauteng.
“Client” / “you” / “your”
Refers to the individual, property owner, property manager, or entity engaging Takesure Painters to perform services.
“Services”
Refers to all painting, waterproofing, surface preparation, repair, and related work performed by Takesure Painters as described in a quotation or service agreement.
“Quotation”
Refers to the written document issued by Takesure Painters detailing the scope of work, materials, timeline, and pricing for a specific project.
“Property”
Refers to the residential, commercial, or industrial premises where Services are to be performed.

3. Quotations and Acceptance

All quotations issued by Takesure Painters are based on an on-site inspection of the property. Quotations include a detailed breakdown of surfaces to be painted, materials to be used, labour costs, and any preparation or repair work required.

Quotations remain valid for 30 calendar days from the date of issue. After this period, Takesure Painters reserves the right to revise pricing due to changes in material costs, labour rates, or property condition.

Acceptance of a quotation may be communicated verbally, in writing, via email, or via WhatsApp. Once accepted, the quotation forms a binding agreement between the client and Takesure Painters, subject to these Terms and Conditions.

Scope Changes: Any work requested beyond the scope described in the accepted quotation will be quoted separately and requires client approval before proceeding. Takesure Painters will not perform additional work without your consent.

4. Pricing and Payment Terms

All prices quoted by Takesure Painters are in South African Rand (ZAR) and include VAT where applicable. Prices cover the materials, labour, and preparation work specified in the quotation.

Projects Under R20,000
No deposit required. Full payment is due upon completion and final inspection of the work.
Projects R20,000 and Above
A deposit is required to secure the project start date. The remaining balance is payable in milestone instalments tied to completed and inspected stages of work, as outlined in the quotation.
Payment Methods
Payment may be made by electronic funds transfer (EFT), cash, or other methods agreed upon in writing. Banking details are provided on the invoice.
Late Payment
Invoices are payable within 7 calendar days of issue unless otherwise agreed. Takesure Painters reserves the right to suspend work on any project where payment is overdue by more than 14 days.
Price Adjustments: If the on-site condition of surfaces differs materially from what was visible during the initial inspection (for example, hidden water damage uncovered during preparation), Takesure Painters will notify you and provide a revised quotation for the additional work before proceeding.

5. Scheduling and Project Timelines

Project start dates are confirmed once a quotation is accepted and any required deposit is received. Takesure Painters makes every reasonable effort to begin and complete work within the timeframe communicated in the quotation.

Estimated timelines are provided in good faith but are not guaranteed. Factors that may extend project duration include:

Weather Delays
Rain, high humidity, or extreme temperatures can prevent the application of paint or waterproofing coatings. Work is paused during unsuitable conditions to protect coating quality.
Hidden Defects
Concealed damage such as moisture penetration, structural cracks, or failed substrates discovered during preparation may require additional work not included in the original quotation.
Client-Requested Changes
Changes to colour selections, scope of work, or access arrangements during the project may extend the completion date.
Access Restrictions
Limited access to certain areas of the property, security estate entry requirements, or restricted working hours may affect scheduling.

Takesure Painters will communicate any anticipated delays promptly and provide a revised completion estimate.

6. Client Responsibilities

To enable Takesure Painters to perform the agreed services efficiently and safely, the client agrees to:

Access
Provide reasonable access to the property during agreed working hours. For security estates, the client is responsible for arranging entry permits or access codes for the painting team.
Preparation
Remove or secure fragile, valuable, or sentimental items from rooms being painted. While Takesure Painters covers furniture and floors with dust sheets, items of high value should be relocated by the client before work begins.
Water and Electricity
Provide access to running water and electrical supply as needed for pressure washing equipment, lighting, and other tools used during the project.
Existing Defects
Disclose any known defects, previous water damage, structural issues, or asbestos-containing materials in the property before work begins.
Pets and Children
Keep pets and young children away from active work areas for their safety and to prevent contact with wet paint, solvents, or equipment.

7. Materials and Products

Takesure Painters uses quality paint products from established South African brands including Dulux, Plascon, and other reputable manufacturers. The specific brand and product type for each surface are specified in the quotation.

Where a client requests a particular brand, colour, or product not included in the original quotation, Takesure Painters will source the product and adjust the quotation accordingly. Availability of specific colours or products is subject to manufacturer stock.

Leftover paint from the project is provided to the client for future touch-up purposes. Takesure Painters retains a record of all products and colour codes used on the property.

8. Workmanship Warranty

Takesure Painters provides a workmanship warranty on all completed projects. This warranty covers defects in application, including peeling, flaking, blistering, or uneven coverage that result from faulty workmanship rather than external factors.

Warranty Period
The standard workmanship warranty is valid for 12 months from the date of project completion.
Warranty Coverage
Defects caused by faulty preparation, improper paint application, or insufficient coating thickness are covered. Takesure Painters will rectify such defects at no additional cost within the warranty period.
Warranty Exclusions
The warranty does not cover damage caused by physical impact, alterations to the painted surface by third parties, structural movement, new water leaks occurring after completion, exposure to chemicals, or normal wear and tear.
Paint Manufacturer Warranty
Paint products carry their own manufacturer warranties separate from the Takesure Painters workmanship warranty. Manufacturer warranty claims are subject to the terms and conditions of the paint supplier.
Warranty Claims: To lodge a warranty claim, contact Takesure Painters by telephone or email with a description and photographs of the defect. A site visit will be arranged within 14 days to assess the claim.

9. Limitation of Liability

Takesure Painters carries public liability insurance covering damage to your property and injury to personnel during the course of work. In the event of accidental damage caused directly by the painting team during the project, Takesure Painters will repair or compensate for the damage.

Takesure Painters is not liable for:

Pre-Existing Defects
Damage or deterioration that existed before work commenced, including structural cracks, rising damp, roof leaks, or termite damage not visible during the initial inspection.
Colour Variations
Minor colour variations between paint samples, digital colour displays, and the final applied finish. Painted surfaces may appear different under varying lighting conditions. Takesure Painters recommends testing a sample area before full application.
Third-Party Damage
Damage to painted surfaces caused by other contractors, tenants, or third parties after project completion.
Consequential Loss
Indirect or consequential losses including loss of income, loss of use of property, or costs arising from delays, except where such losses result from gross negligence by Takesure Painters.
Force Majeure
Delays or inability to perform services due to circumstances beyond reasonable control, including severe weather events, natural disasters, civil unrest, pandemics, or government-imposed restrictions.

The total liability of Takesure Painters for any claim arising from a project shall not exceed the total value of the accepted quotation for that project.

10. Cancellation and Rescheduling

The client may cancel or reschedule a confirmed project subject to the following terms:

Cancellation Before Work Begins
If cancellation is communicated more than 48 hours before the scheduled start date, any deposit paid will be refunded in full. Cancellation within 48 hours of the start date may incur a cancellation fee equal to the cost of materials already purchased for the project.
Cancellation After Work Begins
If a project is cancelled after work has commenced, the client is liable for the cost of all work completed to date, all materials purchased or used, and any non-recoverable costs incurred by Takesure Painters.
Rescheduling
Projects may be rescheduled once at no additional cost provided at least 72 hours notice is given. Rescheduled dates are subject to availability.

Takesure Painters reserves the right to cancel or suspend a project if the client fails to meet payment obligations, denies access to the property, or creates unsafe working conditions for the painting team.

11. Health and Safety

Takesure Painters complies with the Occupational Health and Safety Act 85 of 1993 (OHSA) and takes reasonable measures to ensure the safety of both the painting team and occupants of the property during work.

Personal Protective Equipment
All team members are supplied with appropriate protective equipment including safety harnesses for work at height, protective eyewear, and respiratory protection where required.
Scaffolding and Access Equipment
Scaffolding is erected by trained personnel and inspected before use. Fall arrest systems are deployed on any work surface where fall height exceeds 2 metres.
Hazardous Materials
Where work involves solvents, chemical strippers, or torch-on waterproofing with open flame, appropriate safety precautions are taken including fire extinguisher provision and ventilation measures.
Asbestos
Takesure Painters does not remove, sand, drill, or cut asbestos-containing materials. If asbestos is suspected during the course of work, all activity in the affected area is stopped and the client is advised to arrange specialist testing and removal.

12. Insurance

Takesure Painters carries public liability insurance that covers accidental damage to client property and injury to third parties caused during the course of our work. This insurance does not cover damage to items not disclosed to the painting team before work begins, or damage caused by the client’s own negligence.

Clients are encouraged to maintain their own homeowner’s or building insurance to cover risks not related to the painting work, including pre-existing defects, weather damage during the project, and theft.

13. Intellectual Property

All content on the Takesure Painters website at takesurepainters.co.za, including text, images, design, and logos, is the property of Takesure Painters and is protected by South African copyright law. No content may be reproduced, distributed, or used for commercial purposes without prior written consent.

14. Dispute Resolution

In the event of a dispute arising from the provision of services, the parties agree to attempt resolution through the following process:

Step 1: Direct Communication
The client should contact Takesure Painters by telephone or email to describe the concern. A site visit will be arranged within 14 days to assess the issue.
Step 2: Written Resolution
If the matter is not resolved through direct communication, either party may submit a written complaint outlining the issue, desired outcome, and supporting evidence.
Step 3: Mediation
If the dispute remains unresolved after 30 days of written communication, either party may refer the matter to mediation through an independent mediator agreed upon by both parties. Mediation costs are shared equally.
Step 4: Legal Proceedings
If mediation fails, either party may pursue the matter through the appropriate South African courts. The laws of the Republic of South Africa govern these Terms and Conditions.
Consumer Rights: Nothing in these terms limits your right to approach the National Consumer Commission or any applicable consumer protection body under the Consumer Protection Act.

15. Privacy

Takesure Painters collects and processes personal information in accordance with the Protection of Personal Information Act (POPIA). Full details of how your information is collected, used, stored, and protected are available in our Privacy Policy.

16. Website Terms of Use

The Takesure Painters website is provided for informational purposes. While we make every effort to ensure the accuracy of content, pricing information on the website is indicative and subject to change. Final pricing is confirmed only through a formal written quotation following an on-site inspection.

The website may contain links to third-party websites. Takesure Painters is not responsible for the content, accuracy, or privacy practices of external sites.

Takesure Painters reserves the right to modify, update, or remove website content at any time without prior notice.

17. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a South African court, the remaining provisions continue in full force and effect. The invalid provision will be interpreted or modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms and Conditions, together with the accepted quotation and any written amendments agreed by both parties, constitute the entire agreement between the client and Takesure Painters. No verbal representations or promises not contained in these documents are binding unless confirmed in writing.

19. Amendments

Takesure Painters reserves the right to update or amend these Terms and Conditions at any time. Changes are published on this page with an updated revision date. Continued engagement of our services after changes are published constitutes acceptance of the revised terms. The terms applicable to your project are those in effect at the date your quotation was accepted.

20. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any legal proceedings arising from these terms or the provision of services shall be subject to the jurisdiction of the courts of the Republic of South Africa.
